These Terms of Service ("Terms") govern your access to and use of the ProctorPulse platform, including our website, mobile applications, APIs, and all related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.
By accessing or using ProctorPulse, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.
If you are using the Service on behalf of an organization (such as a school, employer, or business), you represent and warrant that you have the authority to bind that organization to these Terms.

Important: ProctorPulse is an independent platform and is not affiliated with, endorsed by, or associated with any certification body, exam provider, or standards organization. Our practice questions are original simulations created for educational purposes. See our Transparency Policy for more details.
You must be at least 13 years of age to create an account. Users under 13 may use the Service only through a parent, guardian, or educator account in compliance with COPPA. Users between 13 and 18 must have parental or guardian consent.
ProctorPulse offers both free and paid subscription plans. Paid plans provide access to additional features, certifications, and question banks. Current pricing and plan details are available on our Pricing page. We reserve the right to modify pricing with 30 days' notice to existing subscribers.
All payments are processed securely through Stripe. By subscribing to a paid plan, you authorize recurring charges to your payment method at the applicable billing interval (monthly or annually). Subscriptions automatically renew unless cancelled before the end of the current billing period.
You may cancel your subscription at any time through your account dashboard. Upon cancellation, you retain access to paid features until the end of your current billing period. No partial refunds are provided for unused portions of a billing period.
We offer a 14-day money-back guarantee for new subscribers. If you are not satisfied within 14 days of your initial subscription purchase, contact us for a full refund. Refund requests after 14 days are handled on a case-by-case basis at our discretion.
Where a "pass guarantee" is offered for specific certification topics, the following conditions apply: you must complete all available practice exams for that certification topic, achieve a passing score on at least three full-length practice exams, and attempt the official certification exam within 60 days of meeting these requirements. If you meet all conditions and do not pass the official exam, you may request an extension of your subscription for that topic at no additional cost. The pass guarantee does not entitle you to a monetary refund. Documentation of your official exam attempt may be required.

All content on ProctorPulse, including but not limited to AI-generated questions, explanations, articles, graphics, logos, user interface design, and software code, is the property of ProctorPulse or its licensors and is protected by copyright, trademark, and other intellectual property laws.
Important disclaimers regarding the Service:
To the maximum extent permitted by applicable law, ProctorPulse and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
Our total aggregate liability for all claims arising from or relating to the Service shall not exceed the amount you paid to ProctorPulse in the twelve (12) months preceding the claim.
Either party may terminate these Terms:
Upon termination, your right to use the Service ceases immediately. We may retain certain data as described in our Privacy Policy. Sections that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law) shall survive.
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date and notify you through the Service or by email. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and delete your account.
These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.
You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against ProctorPulse.
